The principle Judge, Dr Yorokamu Bawine has directed Gulu Resident Judge, Margret Motonyi to study all the files related to the cost in election Petition N0.03 of 2011 in Kidega Nabinson James VS the electoral commission and Odonga Otto.
Yorokamu Bwamwine said he had received a complaint from Mr Kidega’s lawyers, M/S Okello –Oryem &Advocates stating that their client had already paid cost awarded by court in relation to the 2011 case yet he[Kidega] has been served with an arrest warrant from Gulu high court.
In his letter dated 11th, May 2016 to Gulu resident Judge, the Principle Judge write: ‘‘You are better placed to give guidance to the Deputy Registrar and take appropriate action in the matter. Please handle as you deem fit.’’
Judge Bamwine’s letter was in response to lawyer Okello-Oryem complaint to his[Bamwine’s office] dated 9th May, 2016. In the complaint, Oryem informed the principle judge that his client lost the case in 2011 and was ordered to pay Shs.37, 637,000.
Oryem further stated that his client had already paid up to 39 million saying evidence of the payment is with the registrar of the high court in Gulu. Lawyer Oryem, wondered then why the registrar of Gulu high court has issued an arrest warrant for his client Kidega James Nabinson.
Kidega James Nabinson told Acholi Times that he is awaiting for Gulu Resident Judge, Margret Motonyi currently hearing election petition case in Jinja high court to finish her assignment before she can look into his case. Mr Kidega said it will be unfair for him to be arrested yet he has already paid what the court ordered him to pay.
When contacted, over the letter from the Principle Judge, Odonga Otto said the letter is ‘‘doctored from Nasser road’’ in Kampala. Nasser road is famous for printing work and infamous for forgery of documents. But Otto quickly added that even if the letter is authentic, it does not invalidate the arrest warrant issued by the high court in Gulu.
Last week Aswa region police commander, Kwanya Wilson, declined to sign the Gulu high court order to arrest Nabinson James Kidega secured on May 3, 2016 by Aciro T/A court ballif & auctioneers acting on behalf of Odonga Otto. Kwanya said the police legal team had identified loopholes in the letter since there was proof that Mr Kidega had paid some money as ordered by court.

Kidege paid a pittance. The Principal Judge should mind his business. I am one of the Lawyers not yet paid by him.
